Board Meeting & Fox Management Group Owes OVER $1,200! (#274)

There's a Board meeting tonite and the e-mails are flying...
Today, Part 1
To graciously accommodate Mara Feldman-Fox's special needs, we will break the Addendum into three sections...
Section 1: Needed repairs to the exterior of '60.
The leakage into Eddie Foss' $10 a month basement living space at '58 is not a unique situation.
Numerous cracks in the exterior masonry of '60 at ground level (and most probably below, as in the case of '58) are obvious and evident.
The visually-obvious breaks in the foundation are large enough to allow either water or insects (or both) access to basement areas including M's condo.
In addition, the exterior window casings are also obviously in need of repair or replacement.

Curiously, Board Member / art therapist Eddie Foss, who was literally eye-to-eye with these breaks in the masonry due to his attempts at gardening, has failed to note or report the damage! (At least there's been nothing about it in the Minutes, which are the official legal record for the Condo...)
How he failed to note or report these obvious structural defects only inches away from his face is a mystery attributable, I believe, to three possible causes.
a) Blindness.
b) Inability to perceive his surroundings and mentally process visual information in a logical fashion.
or
c) Deliberate dereliction of duty as a Board member.
Since he still has a valid driver's license, I think blindness can be ruled out.

Since the defects have not been repaired, it was necessary for me to lay down commercially-available anti-insect treatments to prevent access by the pavement ants who inhabit the garden and sidewalk area.
(The ants had, in fact, made entrances thru the foundation each Spring over the past few years. I had mentioned this at previous Board meetings, but was ignored.)

And, odds are that similar below-ground level leakage problems to the ones in Eddie's $10-a-month '58 basement living space probably exist in the foundations of '60 as well.
Until actually disproved by digging or ground sonar/concrete x-raying, only a total idiot would think otherwise.

At any rate, note is being made of this matter to the Board and it's servant via this e-mail, and a hardcopy of this document plus additional photos will be delivered to the Department of Buildings for the county by hand along with photos of the repair work done for Eddie's $10-a-month '58 living space.

As it is now, legally, a pre-existing condition, any damage to M's unit attributable to this uncorrected matter "outside our drywall" as they say, and reported after this date is your responsibility.
But, getting repairs done shouldn't be a problem, considering the way you recently handled a similar matter where Eddie's $10 a month '58 basement living space was concerned.
That, by the way, segues into Section 2...(clever, eh?)

As you have serious concerns regarding the structure of the building, I believe it is imperative that you attend tonight's meeting.
I will pass this information on to the Board of Directors for review and consideration.

Dear Mara:
I'd be happy to, if it were accessible.
Since M is currently suffering from joint pain and can barely walk, and I from periodic bouts of gout, neither of us can easily reach the over-a-mile distant meeting place in an unsafe neighborhood, since neither of us drives and the bus at that time of night is sporadic, at best.
Plus, why would you WANT someone who, according to Eddie and you; "...knowingly and persistently put the entire association at risk." at the meeting?
Sounds like you don't believe what you wrote.

And, you don't have to "pass it on", kiddo.
They've already received it. ;-)

NEW Repairs & Fox Management Group Owes OVER $1,100! (#268)

A previously-unseen repairman showed up to patch leaks around the common area basement spaces the Ed-iot hasn't co-opted for his personal use (yet).
Curiously, unlike the high-priced, extremely-reputable company used to fix the leak in art therapist Eddie Foss' $10-a-month basement living space, the common areas get a cheap journeyman who may not even have a contractor's license...and who did a sloppy job on top of it!
Of course, Fox and Foss will try to lump the two jobs together in the Meeting Minutes, so that Eddie's higher-priced better quality work will be "mixed-in" with the cheaper work done for the rest of us!

Eddie Re-Inhabits & Fox Management Group Owes OVER $1,100! (#267)

Art therapist Eddie Foss spent the weekend working on his $10 a month basement living space. The lights burned late on Saturday.
Guess he hasn't any social life. Not surprising. Bitter old men rarely do.
Presumably, he'll match the old furniture arrangement (see above).

Basement EXPOSED (4) & Fox Management Group Owes OVER $1,000! (#265)

On Friday, 9/11, workmen showed up to dig out the front of Eddie Foss' $10-a month basement living space.
There is, indeed, a crack in the foundation, enough to cause leakage problems, but not enough to compromise the building's structural integrity.
Of course, the condo owners will end up paying for it, even though the only person the repairs will benefit is...art therapist Eddie Foss!
Interestingly, both yesterday and today a notice was posted to leave the gate open so workmen could get in...and NO workmen appeared!
Think they heard about Fox Management's apparent failure to pay their bills (see below)? ;-)
A lone worker (from Streich Corporation, a company I've never heard of) showed up this morning and started patching.
Odds are this company hasn't had dealings with Fox Management Group before.
They'll learn...the hard way, unfortunately.
Now the usual gang from Enterprise is back, putting the dirt back.
It'll be interesting to see how much all this will cost...

Where's Mara? (4) & Fox Management Group Owes OVER $1,000! (#259)

On an interesting side-note to yesterday's developments, I mentioned that we had not received the July 2009 Minutes in several e-mails to both Mara Fox and the Board,,,
July 24th...
Surprisingly, Mara actually managed to send the assessment notice before the 20th!
(First time in over a year!)
But, as I predicted, Eddie failed to provide the minutes for the July
Board meeting in a timely manner, so it'll be almost Labor Day before we find out the fate of the vote for the '58 basement space.
Could he be stalling because the Board finally came to it's senses and realized they desperately need the money M would pay?

August 9th...
I had such high hopes for you.
You actually managed to deliver the assessment bill before the 20th for the first time in almost a year (even if you didn't include the July 2009 meeting minutes, but I expected that!)

In neither case did Mara Feldman-Fox or any of the Board members (Secretary & art therapist Eddie Foss, President & business analyst Carol J Krengelis or Treasurer & financial aid manager Diego Arce) mention that the Minutes had, in fact, been sent out!

On August 11th, I asked...
PS: When's the next Board meeting?

Mara DID respond the next day...
The next Board of Directors meeting is scheduled for Wednesday, September 30, 2009 at 6:30 pm.
She DID NOT mention that the info about the meeting was on the Minutes sent out in July!
Considering I was asking about info readily available on the Minutes AND had mentioned in ALL my other correspondence that I had not received the Minutes, a conscientious property manager would have said something like "Do you need a copy of the minutes?"
Mara Feldman-Fox didn't.

Her (deliberate?) failure to provide information is another example of Mara Feldman-Fox and the Board dealing in "lie by omission".

Where's Mara? (3) & Fox Management Group Owes OVER $1,000! (#258)

I emailed Mara last night...
Have the enclosed July 2009 Board Meeting minutes been distributed to Claremont unit owners?
If so, when?
As of this writing, more than 12 hours later, I have not heard back.
I suspect the other unit owners received them either in August or July.
I'll be talking with other unit owners this weekend.
And, I've forwarded the Minutes to my lawyer.

I received a rather terse response...
Minutes were mailed along with the August or September assessments.

So I e-mailed back...
You're not sure which mailing, eh?
Interesting...
How do you bill for work performed if you don't keep records?
At any rate, it's curious we didn't receive it in either mailing...almost as if you were embarrassed by it, or didn't want us to see it.
After reading it, I can understand why...
That was on September 4th.
As of this writing, four days later, I have not heard back.

Where's Mara? (2) & Fox Management Group Owes OVER $1,000! (#257)

On 8/31 we e-mailed Mara Feldman-Fox...
We note that the July 2009 minutes were not included in the August (or July) mailings.
How long does it take Eddie (Foss) to Orwellize the Minutes? (If you need an explanation of the pop culture term, let me know.)
When will we receive the July 2009 Board Meeting minutes?
Will it be before the September 30th Board Meeting mentioned by Mara in her response to the now-legendary Three Days of No Hot Water?

Usually, Mara shoots off a response within 24 hours.
Not this time.
Nothing.
So, today, 9/3, I did a follow-up...
Mara: We have not received an answer to our direct question:
"When will we receive the July 2009 Board Meeting minutes?"
You're usually rather prompt about responding (albeit indignantly).
Is there a reason you haven't responded?
Is there a problem?

We'll let you know what happens...

The Minutes were something of a revelation!
The Board turned down the $3,600 a year proposal.
Not surprising.
But the reason they gave was...shocking!
Art therapist (and secretary) Eddie Foss stated that I was a criminal, and he couldn't rent the space to my wife due to guilt by association!
